//R Products Terms of Use

These //R Products Terms of Use (“//R Product Terms”), apply to any capital purchases of refurbished Pure Products (collectively, “//R Products”). The Hardware Terms of Use apply to the use of any //R Product except as modified in these //R Product Terms of Use.

1.? ?//R PRODUCTS.?//R Products are Pure products that have been restored to like-new condition, typically after being returned or repaired, and have subsequently been tested for quality and functionality to ensure similar levels of reliability and performance as Pure’s new products, the use of which is to these //R Product Terms.

2.? END OF SUPPORT AND END OF SALE.?The End of Support for all //R Products, including any options to renew are set forth in the //R Products Support Terms. End of Sale information is available from the Pure authorized reseller from whom the //RC20 was purchased.

3.? ?NO DARK SITES; PURE1 CONNECTIVITY REQUIRED; REMOTE ASSISTANCE?ONLY.?//R Products must not be used in a dark site. End User acknowledges and agrees that: (a) all //R Product purchases require active and uninterrupted connectivity to Pure1 in order for Pure to provide support; (b) Pure’s obligations as set forth in the //R Products Support Terms are contingent on the End User maintaining uninterrupted connectivity to Pure1; (c) Support for //R Products is limited remote assistance; and (d) Pure provides live support only after Pure has determined, subject to its reasonable discretion, that a Sev-1 issue has occurred.

4.? ?SOFTWARE PATCHES AND FIXES; PURITY VERSIONS.?Subject to Section 3 above and the //R Products Support Terms, Pure may provide proactive software patches or fixes at its discretion. To the extent Pure determines that hardware replacement or upgrade is required for an applicable software patch or fix, End User is solely responsible for any and all costs associated with the delivery, and installation of that hardware. End User acknowledges and agrees that: (a) //R Products are supported only on designated Purity versions as determined by Pure; and (b) Pure is not obligated to support all GA Purity releases on //R hardware. Notwithstanding anything to the contrary herein, End User is exclusively responsible for upgrades for //R Products as Pure does not provide guided or on-site upgrade assistance for //R Products.

5.? ?NO ADDITIONAL GUARANTEES OR COMMITMENTS.?//R Products do not come with or include any other promises, guarantees, or warranties, except as set forth herein. For the sake of clarity, and to avoid confusion, Pure’s Right-Sized Guarantees, Capacity Commitments, or Performance Commitments are not available for //R Products.

6.? ?GENERAL TERMS.?SThese //R Product Terms supplement the Agreement (or other written agreement covering the same subject matter executed by Pure) for the applicable hardware Product purchased by End User. Capitalized terms not specifically defined in these Hardware Terms have the same meaning as in the Agreement. Pure reserves the right to update these Hardware Terms from time to time, as noted by the “Last Updated” date below.
